However, as it has become more widely available, it’s gained attention as a drug with its own set of potential benefits and possible side effects.

The question, “is kratom legal,” is an important one to ask before deciding to try it. Using it in places where it’s outlawed could lead to repercussions with local authorities.

Kratom is legal in many countries and within America, there are many states where kratom is legal.

1. Kratom Is Legal in the United States

Kratom in the United States falls in a gray area. Buying Kratom in the United States is legal.

Thanks to our federalist system of government and the power of the Constitution, states reserve the right to regulate beyond federal regulations. Federalism also applies down the line to the city and local ordinances.

It can be found in head shops, apothecaries, and a variety of alternative medicine shops. It can also be purchased online.

In general, Kratom is legal in America, but it’s regulated differently from state to state. In some places, it’s a controlled substance, while in others it is illegal, despite being legal in the country.

States in which kratom is entirely illegal include Rhode Island, Arkansas, Vermont, Wisconsin, Indiana, and Alabama.

Some states legalized kratom, but cities have the right to ban it. For example, kratom is legal in California but banned in San Diego. It’s legal in Colorado but banned in Denver for human consumption.

If you want to buy kratom, be sure you check the laws where you live so that you understand what the restrictions are in your area. In some places, it’s only legal to purchase and hold if you are over age 18.

2. It’s Legal in Mexico

Mexico doesn’t have the same strict guidelines regarding kratom that many other countries do.

That means that throughout Mexico, it is legal to buy, sell and distribute kratom. It’s also legal to buy and possess it.

Buying Kratom in other countries requires a bit of caution. Be sure you know what you’re getting if you’re buying it in Mexico.

You might be able to buy it widely in Mexico without repercussions, but bringing it over the border may not be legal.

3. Some Asian Countries Have Legalized Kratom

Despite being the major growers of kratom, some Asian countries have banned it, while it’s legal in others. For example, growing kratom in Thailand is currently banned, though it’s legal for medical purposes.

However, other Asian countries have legalized kratom, with restrictions. That includes Israel, Myanmar, Malaysia, Japan, South Korea, Vietnam, and Singapore.

Kratom is legal in Hong Kong, though there are a variety of restrictions for it in other parts of China. However, it is generally legal throughout the entire country.

4. Legal Kratom in Oceania

Oceania includes Australia and New Zealand. Kratom is legal in both places. However, it’s considered a narcotic substance for harm reduction in Australia.

In New Zealand, kratom is not banned. But it is illegal to grow, buy or sell it in the country. It’s legal for possession in some instances, though it’s very tightly regulated.

Kratom is classified as a Schedule 1 substance in New Zealand. Having a prescription for it allows you to have access to kratom on the free market.

5. Countries in Europe Where Kratom Is Legal

Europe consists of a huge number of countries, each with its own laws surrounding kratom and other substances. Before traveling to any of them, it’s a good idea to familiarize yourself with the restrictions.

In most European countries, kratom is illegal. However, it may be available in a select few. That includes Ireland, Italy, and the UK, where guidelines about its sale don’t appear to be as strict.

Aside from Latvia, Finland, Denmark, Russia, Sweden, Poland, Lithuania, and Romania, where kratom is definitely illegal, restrictions are a bit more relaxed regarding kratom. It could be legal in some places, but not others.

The Kratom Consumer Protection Act

The Kratom Consumer Protection Act(KCPA) is an effort to preserve the sale of kratom as an herbal option. Historically, it’s been used since the 19th century and proponents advocate its safety when used properly.

Even in countries where it’s grown, kratom has swung between being legal and illegal. This act was born to help regulate the sale and safety of kratom.

If signed into the law, the act would allow people access to legal kratom, but would also regulate where it comes from so consumers can be assured of its safety.

It would also create standards for growers and producers of kratom. Tighter laws would add to the peace of mind for buyers of kratom, as they’d know where it comes from and that it’s safe to sell.

KCPA sets precedent for the regulation of kratom products that are sold on the market.

The act’s regulations force kratom vendors to meet all the requirements and standards of high-quality and safe kratom products.

It is worth noting that the following five states have passed the Kratom Consumer Protection Act:

Oklahoma is officially the fifth state to pass the KCPA. The state passed the act in May 2021.

The Specific Restrictions

Kratom in California is legal in all parts of the state besides San Diego, where a bill to ban kratom passed in 2016.

In Denver, Colorado, and in other towns throughout the state, kratom cannot be sold as a product for human consumption, or at all.

Sarasota, Florida banned sales of kratom throughout the city.

Hawaii looks to ban or restrict kratom sales.

Idaho has pending legislation on product labeling and vendor registration. The state is also in the process of penalizing sales to minors.

Overall, Illinois allows the sale of kratom to those over 18, except in some parts of the state.

Unsuccessful many times in the past, Kentucky is still looking to ban kratom.

Louisiana has pending legislation regarding the distribution of kratom in all forms.

Maryland looks to ban kratom.

Michigan looks to classify kratom as a Schedule II drug.

Minnesota considers the sale of kratom to minors as an offense.

Some cities and counties in Mississippi have a kratom ban.

New Hampshire allows the sale of kratom to those over 18, but there are some local bans on kratom.

New Jersey looks to ban kratom.

North Carolina allows the sale of kratom to those over 18.

Tennessee declared kratom legal only in its natural form. Kratom is legal for sale to those over 21.

Please note that this information is recent as of the date of publishing. Regulations and laws about kratom may change over time, especially for states with pending legislation in the works.

States Without Pending Legislation Against Kratom

Kratom is legal in the following states and there is no known legislation against kratom.

In other words, there are no legal consequences for the purchase of kratom for those of legal age.
